Terms of Use

These Terms of Use govern access to and use of the website www.adlernext.in and all associated services, owned and operated by AdlerTech Innovations OPC Pvt. Ltd. (CIN: U72900PN2020OPC194593), having its registered office in Kagal, Kolhapur, Maharashtra, India. By accessing or using the Platform in any capacity as a visitor, Learner, or Instructor, you agree to be bound by these Terms.

Access to and use of the Platform is conditioned on acceptance of, and compliance with, these Terms. These Terms apply to all visitors, Learners, and Instructors.

Specific roles are additionally governed by the Instructor Agreement for Instructors, the Learner Terms and Conditions for Learners, the Privacy Policy, and the Refund and Cancellation Policy, each of which is incorporated herein by reference.

Users must be at least 13 years of age to create an account. Users between 13 and 18 years of age must use the Platform under the supervision and consent of a parent or legal guardian.

By using the Platform, you represent that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

Users must provide accurate, current, and complete information during registration and keep such information updated.

Users are solely responsible for maintaining the confidentiality of login credentials and for all activities occurring under their account.

The Company reserves the right to suspend or terminate accounts found to contain false information or used in violation of these Terms.

Users agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Upload, transmit, or distribute any content that is defamatory, obscene, infringing, or harmful.
• Attempt to gain unauthorized access to the Platform, other user accounts, or Company systems.
• Use automated means such as bots or scrapers to access or extract data from the Platform without authorization.
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Platform.
• Impersonate any person or entity or misrepresent affiliation with the Company.

The Platform, including its design, logo, brand name AdlerNext Learning, tagline Learn Today. Lead Tomorrow., software, and underlying technology, is the exclusive property of AdlerTech Innovations OPC Pvt. Ltd. and is protected under applicable intellectual property laws.

Course content remains the property of the respective Instructor and/or the Company as set out in the Instructor Agreement, and is licensed to Learners for personal, non-commercial educational use only.

No part of the Platform or its content may be reproduced, distributed, or used to create derivative works without prior written permission from the Company.

The Platform may contain links to third-party websites or services, including payment gateways, that are not owned or controlled by the Company. The Company is not responsible for the content, policies, or practices of any third-party services.

The Platform is provided on an as-is and as-available basis. The Company makes no warranties, express or implied, regarding uninterrupted or error-free operation of the Platform.

The Company does not guarantee specific learning outcomes, employment prospects, or third-party recognition of certificates issued through the Platform, though it maintains quality controls, including the 3.5 rating threshold framework, to uphold content standards.

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Platform.

The Company's aggregate liability arising out of these Terms shall not exceed the amount paid by the User to the Company in the 3 months preceding the claim.

Users agree to indemnify and hold harmless the Company, its directors, employees, and affiliates from any claims, losses, or damages arising from their breach of these Terms or violation of applicable law.

The Company reserves the right to suspend or terminate any User's access to the Platform, with or without notice, for violation of these Terms, fraudulent activity, or conduct harmful to the Platform, other Users, or the Company's reputation.

These Terms are governed by the laws of India. Subject to dispute resolution, courts at Kolhapur, Maharashtra shall have exclusive jurisdiction.

Disputes shall first be referred to good-faith negotiation, failing which they shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by the Company, seat at Kolhapur, Maharashtra, and proceedings in English.

The Company reserves the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
